Selling a Florida House Under Guardianship

Start with the guardian's actual authority and the attorney's approval sequence, then build the property-sale plan around them.

A guardianship home sale involves more than finding a buyer. The person managing the property must understand what they are authorized to do, which court steps apply and how the proposed sale supports the owner's situation. Start with the guardianship attorney before promising a listing date, repair budget or closing.

Ask for the authority sequence in writing

Florida Statutes section 744.441 places specified guardian powers within a court-approval framework. Subsection (12) includes selling real property, including homestead. The appointment, scope of authority and applicable orders must be reviewed for the particular transaction.

Ask counsel to explain which decisions can happen now, which require approval and what evidence should accompany a request. A guardian of the person is not automatically the right signer for property documents. Do not treat possession of a key, a family relationship or a general understanding of the case as proof of sale authority.

Prepare a property packet, not a medical file

The property discussion can begin with the address, occupancy, condition and a list of known financial obligations. Ask the attorney which ownership and court documents the closing professional needs. Keep private health and financial information in the appropriate professional channels. A real estate inquiry does not require a diagnosis or a copy of the court file.

Compare preparation without committing estate money

Ask for two practical options: marketing in the current condition and completing a limited, defined preparation scope. For each, list expected work, vendor quotes, carrying costs and uncertainties. A larger hoped-for sale price does not establish that spending is appropriate or authorized.

Record who may approve work and how invoices will be handled. If a contractor finds a larger problem, pause for the agreed decision process instead of treating the original estimate as permission for every additional expense. Mo can coordinate access and property information without controlling guardianship funds.

Build the sale calendar around counsel's process

Keep marketing, contract and court milestones on separate lines. Ask when an offer may be signed, what conditions counsel requires and how a proposed change should be reviewed. There is no universal closing timetable in this guide. Buyers should receive an accurate explanation of applicable transaction conditions without unnecessary disclosure of private family circumstances.

Prepare an update format that records completed steps, outstanding documents, responsible professionals and the next decision. That is more useful than repeatedly asking whether the sale is nearly finished. Keep the signed documents and any later changes together for the authorized participants.

Coordinate the real estate work

Ask Mo to help organize the property's sale-readiness review alongside your attorney and closing professional. Mo can discuss condition, pricing, marketing and transaction logistics. He does not determine capacity, interpret a guardianship order, select a legal strategy or promise approval. The first useful outcome is a clear, authorized next step.

What the court sees before a guardianship sale

Checked October 25, 2026 · Florida statutes and local court offices in plain words

Under Florida Statutes section 744.447, a guardian asks the court for authority to sell by petition. The petition states:

Notice of the petition goes to the ward, the next of kin and anyone who has filed a request for notices, unless the court waives it or one of the statute’s exceptions applies. If the court authorizes a private sale, section 744.451 says the order describes the property and fixes the price and terms.

That is why a contract signed before the order should say the sale depends on court authorization: the judge reviews the actual price and terms, and section 744.441 lets a guardian of the property sell only after that approval. Ask the guardianship attorney to draft or approve that wording and the timing around it.

Local court offices. A home in The Villages sits in Sumter, Lake or Marion County. All three are in Florida’s Fifth Judicial Circuit, which also covers Citrus and Hernando counties. Each county clerk keeps and audits the guardianship files filed there, and each says its staff cannot give legal advice: Sumter County Clerk, Lake County Clerk and Marion County Clerk. Your attorney confirms which court handles the case.

Ask your title company. Early in the process, ask the title company which guardianship papers it needs to insure the buyer’s title. Two to ask about are the letters of guardianship, which under section 744.345 state whether the guardianship covers property and, if it is limited, the guardian’s powers, and the court order authorizing the sale. Your attorney and the title company decide what is delivered or recorded at closing.

Turn the checklist into your next move.

Bring the property and the decision you are weighing. Mo can help organize the real estate next steps and identify what needs an answer from your lender, insurer, title company or attorney.
