Resolve the PACE assessment before it complicates closing

An assessment that appears on the tax bill is still a financing issue. Confirm disclosure, payoff and buyer-lender requirements early.

Identify the financing behind the improvement

If a roof, energy upgrade or other improvement was financed through PACE, collect the financing agreement before preparing the listing. Do not describe the improvement as paid off because there is no ordinary monthly loan bill. Fannie Mae's PACE guidance describes financing generally repaid through the real-estate tax bill and explains how lien priority can affect mortgage eligibility.

Ask the program administrator for the current balance, annual assessment, remaining payment schedule and a written payoff valid for the expected closing period. Keep this separate from a solar lease, power-purchase agreement or ordinary contractor loan. Those arrangements should not be given the same answer simply because they funded a similar improvement.

Do not equate transfer with lender acceptance

A buyer's willingness to discuss an assessment does not establish that the buyer's lender will accept it. Fannie Mae's guidance restricts mortgages involving outstanding PACE debt with priority over the first mortgage. Have the actual lender review the assessment documents and confirm the proposed closing treatment.

Ask the closing professional whether payoff, release or other documentation is needed and when it must be obtained. Do not promise in marketing that the buyer can simply take over the assessment. Put the verified financial treatment into your seller planning so that an apparent offer price is not confused with the amount you will receive.

Handle disclosure before the contract is signed

Florida Statutes section 163.081(8) addresses written disclosure at or before execution of a residential sale contract when an assessment under that section has an unpaid balance. Have your Florida real-estate attorney or closing professional determine the applicable disclosure and documents for your assessment. This guide does not replace the required form or provide custom legal language.

Gather the installation contract, permit closeout, warranties and financing records as separate items. Completion of the improvement does not answer the financing question, and payoff does not independently establish the condition of the work. Give buyers accurate documentation for both.

If closing moves, request an updated payoff and ask how any assessment installment already paid will be credited. Reconcile the administrator statement with the closing worksheet so the estimate does not omit the obligation or count a payment twice.

Your PACE sale-preparation checklist

Use the seller net sheet to model the financial effect, and review the solar-home guide if panels are involved. Mo can help organize the listing and transaction questions, while the administrator, lender, closing professional and attorney determine the applicable terms. No automatic transfer, lender acceptance or payoff amount is promised. Early clarity gives you a more reliable sale plan.

Turn the checklist into your next move.

Bring the property and the decision you are weighing. Mo can help organize the real estate next steps and identify what needs an answer from your lender, insurer, title company or attorney.
